Buying a home in Spain as a foreign buyer: first steps
Buying a home in Spain means planning your search and paperwork in advance, especially if you live in another country. This guide is a starting point for preparing questions and documents. The exact requirements depend on your circumstances and transaction; confirm them with the notary and your professional advisers before signing.
Decide how you will use the property and set a total budget
Decide whether you want a main residence, a second home or a property you intend to rent out. Your intended use affects the checks you need. Allow for purchase costs, financing, maintenance and possible renovations. If you need a mortgage, ask the lender in advance about the documents required and the terms it may offer.
What is a NIE, and why organise it early?
The Número de Identidad de Extranjero identifies foreign nationals in their economic, professional or social dealings with Spain. The Ministry of Foreign Affairs explains that a NIE alone does not prove residence or authorise you to reside in Spain. Ask your consulate or the competent authority how to apply and which requirements apply to you; do not assume every office has the same timescales.
Prepare your documents and payment arrangements
Ask in advance which identity, marital-status and financing documents you must provide. For documents issued abroad, check whether a translation, legalisation or another formality is needed. Coordinate payments and any required source-of-funds checks with your bank and notary.
Check the property before paying a deposit
Review ownership and charges, the owners’ community, the condition of the property and the applicable documents. For a development, ask about deadlines, licences and guarantees for advance payments. Understanding a reservation or deposit agreement is essential: its terms can create obligations before the public deed is signed. Ask for an explanation of any clause you do not understand.
Plan completion and the steps afterwards
If you cannot attend in person, ask the notary whether a power of attorney is suitable and which formalities it requires. Also arrange how you will understand the language of the documents and the signing process. After buying, confirm the tax, registration and utility procedures and maintenance obligations that apply to you. Buying a property and obtaining permission to reside are separate matters.
